Sacked AAP ex-minister arrested for Rape Charges

NEW DELHI: In a dramatic development, the woman who featured in the sex CD of former AAP minister Sandeep Kumar turned up at the Sultanpuri police station in outer Delhi on Saturday and accused him of raping her. Police registered an FIR against the MLA after which he was arrested late in the evening. The woman said in her complaint that she had approached the minister for a ration card and was trapped. He took her to a place which she can't recall, gave her a drink laced with sedatives and raped her when she was drugged, she alleged. Claiming that the incident happened 11 months back, she said she was unaware that she was being filmed. Police claimed the video was shot with a hidden camera. The woman, who is married, said she and the MLA live in the same locality and she would often cross his house while going to the market. The police have invoked section 376 (rape) and 328 (poisoning) of IPC besides section 67A of the IT Act (publishing or transmitting sexually explicit content) and section 7 (public servant taking gratification other than legal remuneration in respect of an official act) of the Prevention of Corruption Act. "He (Sandeep) used to be alone at his house in the evening. I had met him on the way one day, and he promised to get me a ration card after I told him that I was unable to do so. But he said I would have to go to his office to get it done. He used to stay at A-4 and had called me there... then he did all these things to me...I did not know that he was making a video," the woman said. She said this happened only once. "I told him that whatever he had done was wrong, but he said 'you will need a ration card, won't you?' Finally, he did get me a ration card; I got it made at a different address," she said, explaining that she didn't want to go back to him for that purpose. The woman has said she wants the MLA punished. "He should have known that along with me, he was also maligning himself. I am a poor woman. I don't want to be maligned any longer. I have children who will face the brunt," she has said, expressing concern about the plight of her family. The case will now be probed by the Outer Delhi police with special CP SBK Singh supervising it. Earlier, the case was being probed by the crime branch and a special team had been formed for this purpose. On Friday afternoon, the SIT had questioned Om Prakash, who had handed over the CD to news channels and the Delhi government. He will be questioned afresh by the Outer Delhi police, probably next week. Sources said Prakash, a political worker from Sultanpur Majra, was questioned at Connaught Place by a sub-inspector of the inter-state cell. "He said he was just a postman and had handed over the CD given to him by a stranger. He also demanded security, claiming there was a threat to his life. He promised to cooperate in the probe," said an officer.
Police will also ask TV channels and the Delhi government to submit the CD for verification. The nine-minute clip and 11 photographs will be sent to a forensic laboratory to ascertain if there was any tampering, a source said. Police will also try to identify the second woman in the photographs and ask her if she had been exploited as well. After that, another FIR may be registered on her complaint. On Thursday evening, the police chief had asked the crime branch to investigate the matter after BJP MP Parvesh Sahib Singh and others had met him at his office and handed over a written complaint.
Meanwhile, ACB has also started a parallel probe after BJP MLA O P Sharma and RTI activist Vivek Garg filed complaints. They have alleged misuse of office and demanded a probe to find out if the sacked minister had exploited other women too. It was alleged that Kumar had himself made the video to exploit the two women and misused his office.
